OVERVIEW OF GENERAL WARRANTY AND RETURN POLICY

You may return most new, unopened items within 30 days of delivery for a full refund or exchange. We'll also pay the return shipping costs if the return is a result of our error (you received an incorrect or defective item, etc.).  Note: you will need an RMA (Return Merchandise Authorization) number to return any items.

If you need to return an item, simply login to your account, view the order using the "Complete Orders" link under the My Account menu and click the Return Item(s) button. We'll notify you via e-mail of your refund once we've received and processed the returned item.

You can also contact us directly and we can issue you an RMA number and get the details of the issue via email or over the phone.

You should expect to receive your refund within a few weeks of giving your package to the return shipper, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (1 to 3 business days), and the time it takes your bank to process our refund request (5 to 10 business days).

DETAILED BUSINESS POLICY, RETURN POLICY AND LIMITED WARRANTY

The Newman Trading Company LLC (TNTC) DBA BLUEROCK Tools® makes every effort to assure that its products meet high quality and durability standards, and warrants to the original purchaser that this product is free from defects in materials and workmanship for the period of 30 days from the date the customer purchases the item. ---This warranty does not apply to damage due directly or indirectly, to misuse, abuse, negligence or accidental, repairs or alterations outside our facilities, or to lack of maintenance. We shall in no event be liable for death, injuries to persons or property, or for incidental, contingent, special or consequential damages arising from the use of our product.  The purchaser of this item acknowledges that TNTC shall in no way be responsible or liable to purchaser or any other party for any use or misuse of this item.  The purchaser acknowledges that the purchaser has not and does not rely on TNTC’s skill or judgment with regard to the selection of the goods as fit or suitable for any particular purpose.  --- To take advantage of this warranty the purchaser must notify TNTC of intent to return and the product or part must be returned to TNTC with transportation charges prepaid.  Proof of purchase date and an explanation of the complaint must accompany the merchandise.  If our inspection verifies the defect, we will either repair or replace the product at our election or we may elect to refund the purchase price if we cannot readily and quickly provide you with a replacement.  Within this 30 day period the purchaser may also elect for a refund, not including shipping costs. We will return repaired products at our expense, but if we determine there is no defect, or the defect resulted from causes not within the scope of our warranty, then you must bear the cost of returning the product.  If the item is not returned in “new” condition with all packaging and accessories, it will have a minimum 15% refurbishing fee- maximum refurbishing fee will be accessed upon inspection of the item.  --- This warranty gives the purchaser specific legal rights and you may also have other rights which vary from state to state.  TNTC reserves the right to forum any legal disputes in courts residing in the State of Washington. --- All Sales Fall under FOB Origin Terms. Title and risk of loss pass to the buyer upon BLUEROCK Tools' tender of the product to the common shipping carrier.  --- The foregoing warranty is expressly made in lieu and in place and stead of all other warranties express or implied including any warranty of merchantability or fitness for any purpose and of any other liability or obligation.  The foregoing warranty shall not apply to any goods or parts, which have been subject to improper installation, accident, negligence, alteration, abuse or misuse.

BLUEROCK TOOLS EXTENDED WARRANTY PARTS PLAN V1.0 (ONLY SOLD ON CERTAIN ITEMS)

1-Year Extended Warranty

COVERAGE SUMMARY: This Plan covers parts necessary for You to repair Your Product(s) for problems due to functional part failures unless otherwise stated below. This extended parts warranty covers defects in workmanship or materials. Standard wear parts and consumables are not covered in this extended warranty.  Extended warranty does not cover damage to the machine caused by: product abuse, misapplication, end users attempt to improperly repair item, cleaning or routine maintenance.  These type of damages may void this extended warranty.  Contact the Plan Administrator to discuss parts needs and product issues within warranty once the necessary parts are defined.

This Plan is not a contract of insurance.

These terms and conditions, together with Your sales receipt shall collectively constitute the entire contract relating to Your coverage. Your sales receipt describes the covered Product(s) and the term of this Plan. The terms and conditions are required for service. Limitations and exclusions may apply; refer herein for details.

Definitions:

  • Payment means a check, credit card, PayPal transaction, Amazon transaction or merchandise credit with the Plan Seller.  This payment list is not exhaustive.   
  • Plan Holder/You/Your means the owner of the Product(s) covered under this Plan.
  • Plan Provider/We/Us/Our means the entity that is contractually obligated to You under the terms of this Plan. The Plan Provider is The Newman Trading Company LLC (DBA BLUEROCK Tools). 
  • Plan Administrator means the entity responsible for the administration of this Plan. The Plan Administrator is The Newman Trading Company LLC (DBA BLUEROCK Tools).
  • Plan Seller means the retailer where You purchased Your Plan as indicated on Your sales receipt.
  • Product(s) means the specific item(s) that You purchased the Plan for, but does not include other items (such as other items listed on the sales receipt for which You declined to purchase a Plan).
  • Plan means this Plan, as identified on Your sales receipt, which You purchased to cover the Product(s) described on Your sales receipt.
  • Price means the consideration paid by You for this Plan as listed on Your sales receipt.
  • Retail Cost means the amount charged to You, pre-tax, for the Product for which You bought the Plan.

DAY ONE BENEFITS:  THIS PLAN PROVIDES NO DAY ONE BENEFITS OR COVERAGE DURING THE TERM OF THE MANUFACTURER’S PARTS AND LABOR WARRANTY, UNLESS OTHERWISE PROVIDED BELOW.

COVERAGE PERIOD: UPON EXPIRATION OF THE MANUFACTURER’S WARRANTY, YOU ARE ENTITLED TO THE COVERAGE DESCRIBED HEREIN, UNLESS OTHERWISE PROVIDED BELOW.

MANUFACTURER’S RESPONSIBILITIES: Parts covered during the manufacturer’s warranty period are the responsibility of the manufacturer. Your Product(s) may provide a parts warranty from the manufacturer that may provide additional or overlapping coverage. Review Your manufacturer’s warranty. Nothing in the Plan shall be deemed to limit or discharge any manufacturer’s obligations.

FOR ALL PRODUCT PLANS: See Your sales receipt to determine which coverage plan(s) You purchased and apply to You and Your Product(s).

COVERAGE: This Plan covers parts necessary for You to repair Your Product(s) for problems due to functional part failures unless otherwise stated below. Genuine manufacturer’s parts will be used whenever possible; however, the use of non-original manufacturer’s and re-manufactured parts is allowed under this Plan.

This extended parts warranty covers defects in workmanship or materials. Standard wear parts and consumables are not covered in this extended warranty.  Extended warranty does not cover damage to the machine caused by: product abuse, misapplication, end users attempt to improperly repair item, cleaning or routine maintenance.  These type of damages may void this extended warranty. 

Contact the Plan Administrator to discuss parts needs and product issues within warranty once the necessary parts are defined. We will try to provide repair parts as quickly as possible; however, We are not responsible for delays caused by factors beyond Our control, including, but not limited to: manufacturer’s parts delay, shipping times, or acts of God. You have the duty to protect Your Product(s) against any further damage.

TRANSFERABILITY: This Plan may NOT be transferred to a subsequent owner.

RENEWAL: We are not obligated to offer You another Plan or extend coverage on this Plan.

CANCELLATION: You may cancel Your Plan within the first thirty (30) days of product purchase by contacting the Plan Administrator. You will receive a refund in the amount of one hundred percent (100%) of the Price except as otherwise required by law. For cancellation of Plans containing multiple Products, You will receive a pro rata refund of the Price of the entire Plan except as otherwise required by law. No cancellation fee applies to this Plan. The effective date of cancellation is the date We receive Your request for cancellation of Your Plan. If We cancel this Plan, You will receive a pro rata refund of the Price less the cost of any replacements parts and/or benefits received under the Plan, except as otherwise required by law. You will be provided with a written notice at least thirty (30) days prior to cancellation.

We may use the information we collect to periodically notify you about new services or special offers we think you'll find valuable. BLUEROCK ® Tools shall process and transmit all personal data in accordance with the General Data Protection Regulation (GDRP) as outlined by the European Union (EU).
